A Revocable Living Trust is an estate planning document that allows you, upon your death, to transfer your estate to your intended beneficiaries without court intervention. It enables Lynx Law and your beneficiaries to avoid probate court and override the state’s intestacy laws.
A Pour-Over Will serves as a back-up protection for any property that was not appropriately transferred to the Living Trust during the creator’s lifetime. Upon death, it essentially “pours over” property not included in the original trust into your trust to avoid complicated probate court proceedings. Lynx Law will review your existing documentation to ensure that all of your property is protected and that probate court is avoided where possible.
A traditional Will is a legally enforceable document that states how your estate and affairs will be handled upon your passing. A Living Trust, on the other hand, works in conjunction with a Pour Over Will and provides further guidance for how your estate and assets will be handled and it protects them in the interim. A Living Trust is an essential part of your Estate Planning package.
A Durable Power of Attorney is a legally binding document in which you give authority to a third party to manage your affairs in the event you are unable to do so. This document has no set time. It becomes effective immediately upon incapacitation and expires at death.
An Advanced Health Care Directive, or a Living Will, informs physicians and family members of your healthcare wishes when you are unable to make medical decisions. Through this document, you name the individual who will be your voice regarding your preferences in medical treatment and interventions. It can provide guidance for life-sustaining measures, but also in such areas as nutrition, hydration, resuscitation, and organ donation.
A HIPAA Waiver is a legal document that allows an individual’s health information and/or records to be disclosed and released to a third-party, as required under the Health Insurance Portability and Accountability Act (HIPAA). These third parties include, but are not limited to, researchers, attorneys, family members, and healthcare providers. Lynx Law offers HIPAA Waivers, when necessary, in our comprehensive Estate Planning package.
A guardian is an individual (non-parent) designated to care for and make decisions for a child. These include, but are not limited to, providing food, clothing, and shelter, as well as the educational and medical needs of the child. A guardian essentially provides for the child’s safety and nurtures them physically and emotionally. A Nomination of Guardian document will place the individual you choose to care for your children.
Yes, a Living Trust may be changed, modified, amended, or revoked, provided the Living Trust is revocable and the amendments/modifications/revocations are done during the lifetime of the said individual. Changes, modification, amendments, or revocations may be dependent on the terms outlined in the initial trust, but these are expected. Most individuals that draft a Trust will modify it multiple times over the course of their lifetime. Simple Will Package
