How do I know that I have a valid personal injury case?

Every case has unique circumstances, but in general, Oregon law requires wrongdoers to be held accountable for the damages they cause to others. This means that you would have valid grounds to pursue compensation if you can prove that the other party has breached a “duty of care,” that they have acted negligently in some manner and that you have suffered an injury and/or a substantial loss as a result. How long do I have from the time of my injury to initiate a lawsuit?

In the state of Oregon, all personal injury cases are subject to a statute of limitations. This means that you only have a certain amount of time to initiate a lawsuit, and subsequently pursue compensation. Each state in the U.S. maintains different time limitations, but in Oregon, a wrongfully injured victim generally has two years from the date of their injury to pursue a case. If the injury was not immediately discovered, however, one may be afforded more time to file a lawsuit. In order to ensure that your ability to claim compensation is not jeopardized, it is highly recommended that you contact us as soon as possible so we may evaluate your case.

Will my case go to court?

Most personal injury cases don’t go to trial. Most often, cases are settled, either directly, or through a mediator or settlement judge. This is great for you because court cases are long and expensive, as well as risky. If necessary, we are not afraid to pursue a case through trial so you can rest assured that we will take the appropriate steps to acquire the compensation you deserve – whether your case is handled through mediation or trial.

What damages can I recover?

Oregon allows you to recover three types of damages: economic damages, non-economic damages, and punitive damages.  Practically speaking, there are only a few cases where punitive damages make sense, and these cases generally require extensive and costly litigation. Economic damages might include car repair costs, medical bills, reimbursement for household services that you cannot perform because of your injuries, and lost income resulting from your inability to work because of your injuries. Non-economic damages refer to more intangible damages such as physical and emotional distress, pain and suffering, physical impairment, disfigurement, and loss of the enjoyment of life caused by the accident.

What if I only have a small personal injury case?

Oregon law specifically protects people with small personal injury cases. ORS 20.080 provides a process where injured parties may seek up to $10,000 in compensation, under the threat that the at-fault party will be required to pay damages, court costs, and attorneys’ fees if the injured party prevails and obtains a settlement or award higher than what was offered by the at-fault party. It is the risk of having to pay the injured person’s damages, court costs, and attorney’s fees that makes insurance companies and their insured’s take these claims seriously.

Can I recover even when the liable party had no insurance?

Yes, you can recover if you have uninsured/under-insured motorist coverage. All insurance policies come with Uninsured Motorist (UM) coverage, unless you specifically sign an election to not have this coverage. UM is on your policy and protects you when you are hit by someone driving without insurance. You will need to open a UM claim through your own insurance company. We strongly recommend retaining an injury lawyer to do this for you because now your own insurance company is your adversary and they will revert back to their desire to pay as little as possible. 

What should I do following a personal injury accident?
